The Avent Instant Advantage Program (the “Program”) is offered by Philips Electronics Ltd. Doing business as Philips Canada (“Philips”) and is available only through participating Toys “R” Us/Babies “R” Us retail locations in Canada, which may be viewed here: https://www.toysrus.ca/storeLocator/search.jsp. Use of the Instant Advantage card (the “Card”) at participating Toys “R” Us/Babies “R” Us retail locations in Canada is governed by these Avent Instant Advantage Program Terms and Conditions (the “Terms”).

Enrollment in the Program

In order to receive a Card and be eligible to participate in the Program you must be a member of the Program. Membership is free. To become a member you can:

Visit https://www.philips.ca/c-e/avent-advantage complete and submit the online application form by entering your complete name and email address and accepting these Terms. Once submitted, you will be able to download and save your digital Card. At the time, you will also receive a promo code that will allow you to receive your Instant discount on the Avent merchandise purchased at www.babiesrus.ca.

Philips reserves the right to refuse issuance of a Card to any customer who does not follow the prescribed enrollment procedures. Any unauthorized reproduction of the Card may lead to legal prosecution and termination of membership in the Program.

Membership in the Program is only available to individuals who have reached the age of majority in their province or territory of residence. Program membership is not available to corporations, businesses, charities, partnerships, enterprises or anyone other than an individual, unless written approval is received in advance from Philips, in its sole discretion. Membership is individual and non-transferable. Breach of this condition may result in termination or suspension of membership.

Instant Discount

Membership in the Program entitles members to receive an instant discount of 10% of the then current price of Avent merchandise purchased at participating Toys “R” Us/Babies “R” Us retail locations in Canada at checkout, subject to these Terms. Instant discount will be provided to the member by reducing the price of the purchased item(s). From time to time, special promotions may be run during which time certain Avent products will be eligible for an instant discount of more than 10% of the then current price. Promotions may vary between participating Toys “R” Us/Babies “R” Us retail locations.

Member’s valid digital Card must be presented to the cashier before the purchase transaction is completed in order to be eligible to receive an instant discount. For online purchases at the Toys “R” Us/Babies “R” Us Canada website, the promo code provided on the membership card must be entered during Step 3: “Payment Method”. Application of the discount can be verified during Step 4: “Review your information”. Void where prohibited.

GST, PST, HST and any other applicable taxes are calculated and payable by the member on the purchase price of the Avent products after any instant discount.

Privacy

Personal information collected during enrolment, at any time upon using your Card or at any time if you choose to opt-in to receive marketing communication will be used for the purposes of administering the Program and may be used to send you marketing communications from Philips and/or Toys “R” Us/Babies “R” Us depending on your instructions. All such information will be subject to the Philips privacy policy as amended from time to time without notice. By agreeing to these Terms, you are also agreeing to the terms of the privacy policy and you undertake to review those terms, as such may be amended from time to time.

During enrolment you may opt-in to receiving marketing communications from Philips, including information and special offers about Avent products and other Philips products or services. You may also receive marketing communication about Toys “R” Us/Babies “R” Us Canada products sent by Philips. If you opt-in, we may use your personal information for the purposes of sending you these communications which communications may be sent to any of the specific email address(es) which you provide to us during enrolment or thereafter. You may also opt-out of these communications at any time by using any unsubscribe mechanism offered by email or otherwise. You may also contact Philips Canada by calling 1- 888-744-5477.

Additional Privacy Information

Please note that your personal data may be transferred from your home country to other Philips companies in different locations around the world, which may communicate with you about Philips’s products, services or special offers that you may be interested in. If local law requires it, we will ask for prior consent to transfer your personal data outside of your geographic region.

Because Philips sells thousands of products and services in hundreds of countries, you may have previously provided us with your personal data through other means, via our call centers or in some other manner. Your decision not to register now will not affect the personal data you have already provided to Philips. Of course, you will always have the option to unsubscribe from any targeted communication from Philips. You can opt-out by using any unsubscribe mechanism offered by email or otherwise.

Program Changes and/or Cancellation

The Program shall run for one year and shall automatically renew unless terminated by Philips or Toys “R” Us/Babies “R” Us at their sole discretion by posting notices in participating retail stores of such termination or suspension and sending by email notice to those registered under the Program by Philips. If events beyond Philips’ control materially affect its ability to operate the Program, the Program may be suspended or terminated without notice. Upon suspension or termination of the Program for any reason whatsoever and to the extent permitted by law, Philips and Toys “R” Us/Babies “R” Us will have no liability therefore to any member and is automatically released from all claims by members in respect of such suspension or termination.

Philips may restrict or otherwise alter any aspect of the Program and Terms without notice. Any material changes to these Terms will be posted online and posted at each participating Toys “R” Us/Babies “R” Us retail location in Canada. You may refuse any changes to the terms and conditions within 30 days after the amendment comes into force at no cost, penalty or cancellation indemnity by sending a notice to Toys “R” Us/Babies “R” Us:  customerservice@toysrus.ca ,or contact Philips at 1- 888-744-5477; however, if you refuse any amendments you will no longer be able to participate in the Program. Your continued participation in the Program at any time after such 30 day period has expired will constitute your consent to be bound by the changes. General Information

The completion of the enrolment form and the acceptance of these Terms in store or online or at the time of completing the registration form and/or first-time usage of a Card at a participating Toys “R” Us/Babies “R” Us retail location constitutes acceptance by the member to these Terms.

The Card is not a credit card, has no cash value and is non-transferable.  Unauthorized reproduction of any Card is prohibited and can result in legal prosecution. The Card is the property of Philips and it may be revoked without notice at any time by Philips in its sole discretion.

Any abuse by a member of the Program’s privileges, any failure by a member to follow these Terms, or any misrepresentation by a member may, at Philip’s sole discretion, result in termination of membership in the Program. These Terms are to be governed by and construed in accordance with the laws of the Province of Ontario, with the exception of residents of Quebec, in which case these Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, and in each case the laws of Canada applicable therein, without reference to conflict of laws provisions. The parties irrevocably attorn to the jurisdiction of the courts of the Province of Ontario, with the exception of residents of Quebec, in which case the parties irrevocably attorn to the jurisdiction of the courts in the District of Montreal, Province of Quebec.
